What’s on the General Assembly’s mind this week?

A flurry of bills were filed this week in both chambers. So much so that your Government Affairs team is still reviewing them as we speak. This week’s spotlight will focus on a couple of NC REALTORS® Legislative Agenda items which have been filed or were heard in committee this week. Both of these items were also on last week’s Legislative Day Talking Points and received a lot of positive support.

First, we are happy to announce that legislation addressing private road maintenance agreements has been filed in both the House and Senate. House Bill 620 is sponsored by Representatives John Szoka, Dana Bumgardner, Zack Hawkins, and Frank Iler, while Senate Bill 480 is sponsored by Senators Tom McInnis, Jim Davis, and Don Davis. We are very appreciative of all of the sponsor’s support of this important issue for current and future homeowners across the state.

Second, House Bill 399, now called the “Historic Preservation Act of 2019” received its first hearing this week in the House Commerce Committee. Multiple committee members spoke in support of the legislation, highlighting the benefit of the program to projects in their communities. The bill received a unanimous favorable report from the committee. It will now move to the House Finance Committee for its next hearing.

Issue Update

Status Update on Association Health Plans

As you have seen in previous editions of the Advocate, Association Health Plans is one of the top items on our 2019-2020 NC REALTORS® Legislative Agenda. Already, two pieces of legislation have been filed both chambers of the General Assembly. Senate Bill 86 received hearings in March, was passed out of the Senate by a bipartisan vote, and now awaits House action. House Bill 464 was filed just last week and has already racked up thirty-nine sponsors in advance of its first hearing.

We continue to hear positive comments from leaders on both sides of the political aisle in support of our proposals.

Last week, a federal court in Washington, D.C. issued a decision that may impact the course of association health plans. The judge’s ruling blocks the Department of Labor’s rules from 2017 which allow for the creation of association health plans. This ruling was in response to a lawsuit filed by 11 attorneys general which argued that the rules violated provisions in the Affordable Care Act (ACA) and the Employee Retirement Income Security Act (ERISA).

We will likely see an appeal on this ruling, but in the meantime, the question remains: what effect will this have on the establishment of association health plans?

The short answer is that while we don’t know at this point, although at least one of the bills introduced in North Carolina doesn't rely on the Department of Labor rules. The ruling muddies the water, but doesn't necessarily prevent us from at least one path forward.

Be assured, we will not give up the fight! This issue is too important to our members and other independent contractors to abandon. NC REALTORS® Government Affairs staff has been in constant communication with NAR staff and outside legal counsel who are reviewing this rule. We support NAR’s statement by President John Smaby in opposition to the ruling due to the importance of affordable health insurance options for members. And we will continue to work with the bill sponsors mentioned above to ensure that needed state legislative structures are in place should the ruling be overturned.

NC REALTORS® State of Real Estate

One week away!

In one week, NC REALTORS® from across the state will descend on downtown Wilmington for the NC REALTORS® State of Real Estate. For two days, April 11 and 12, attendees will have an in-depth discussion on of one of the biggest issues facing our industry: the state of housing. They will also have the chance to see important local landmarks in the Wilmington area which are vital to the area and state economies.

So you want to be on a Board or Commission?

Apply for a recommendation from NC REALTORS®

Each year, the 400+ state boards and commissions spanning all topic areas need new members. Since NC REALTORS® are knowledgeable in both in your industry, as well as involved in other important issues for our state their service on these various boards and commissions is important. NC REALTORS® regularly offers our recommendation for members who are interested in serving through an application process.

This year, important vacancies exist on the NC Real Estate Commission, NC Appraisal Board, and many others. You can find a complete list of current board/commission vacancies on the Governor’s website.

To apply for a recommendation from NC REALTORS®, please complete this application. We also ask that you submit a current resume, as well as a statement of interest. Please email those additional documents to Seth Palmer.

The application deadline for the second recommendation cycle is Friday, May 3. Additional application cycles may be opened later in the year.
